Legalize Marijuana to Decrease Usage

The latest stats show the number of Americans who use marijuana has gone up since last year. If the government really wanted to reduce marijuana use, they would legalize it.

The AFP reports:

SAMHSA also looked at Americans’ marijuana use and found that numbers using pot in the past month were up for the two years covered by the report: 6.4 percent of Americans aged 12 and older said they had used marijuana in the past month compared to six percent in 2007-2008.

In the 12- to 17-year age group, marijuana use fell, but seven percent of US teens still use cannabis, the report said.
The 10 states that saw the highest use of marijuana were Alaska, Colorado, the District of Columbia, Hawaii, Maine, Massachusetts, New Hampshire, Oregon, Rhode Island, and Vermont.

Medical marijuana is legal in all of those states except for Massachusetts and New Hampshire.

Perceptions of the dangers associated with marijuana use were lowest in the 10 states where the drug was used the most, according to the study.

Drug Warriors love to shout in booming voices that if we legalized marijuana, stoners would begin coming out of the woodwork and cause an epidemic of bong-rips and bloodshot eyes. Scientists completely disagree, and say that marijuana law reform does not lead to an increase in usage.

In fact, they say just the opposite. Evidence from countries like Portugal and the Netherlands shows that liberalizing drug laws actually leads to a decrease in usage. Put that in your pipe and smoke it, Drug Warriors.

Marijuana Can’t Kill, But Marijuana Prohibition Certainly Can

Today’s New York Times City Blog features an article about a court settlement between New York City and Jamie Rutkowski. Who is Jamie Rutkowski? Until New York City police decided to arrest her for minor cannabis possession—in a city that is supposed to be issuing civil tickets— locking her up in police detention, creating a health hazard for the young woman with diabetes and ultimately paying her $125,000 in damages, no one knew who she was.

Now, all cannabis consumers in the United States—notably in municipalities and states that have reformed their cannabis laws with decriminalization laws and patient protections for medicinal use—should cite Ms. Rutkowski’s case settlement as precedent against overzealous law enforcement agencies who choose to physically arrest and detain minor cannabis offenders, rather than issue them a civil fine, similar to a speeding or parking ticket.

Kudos to Ms. Rutkowski and her attorney Joel Berger for 1) challenging the NYC police department’s infamous practice of arresting and detaining for many hours minor cannabis offenders and 2) for making it ironically clear that even an arrest on minor cannabis charges can create serious health concerns whereby an adult who chooses to consume a non-toxic and relatively safe recreational drug like cannabis (or, has the drug recommended to them to consume medically by their physician) can quite literally be placed into a life or death situation.

“They could have killed me over a joint,” Ms. Rutkowski said. “Something needs to be done.”

After thousands of years of human use, there is little-to-no scientific evidence that moderate cannabis use is harmful to the individual consumer or society in the whole. However, there is overwhelming and abundantly clear evidence that Cannabis Prohibition can be deadly for individual consumers, law enforcement personnel and those involved in the currently illegal and untaxed businesses of cultivating, transporting and selling cannabis.

Disgustingly, in a city that, since the late 1970s, is supposed to have true ‘decriminalization’ laws for cannabis possession cases, New York City continues to nearly lead the nation in per capita arrests for simple cannabis possession cases (approximately 43,000 cannabis possession arrests annually; constituting nearly five percent of all annual cannabis arrests nationwide) as well as having one of the most racially imbalanced arrest rates for minorities (approximately nine out of ten cannabis arrests in NYC are made against minorities).

After Diabetic Woman’s Arrest, a $125,000 Settlement

Her decision to smoke a marijuana cigarette outside a Manhattan bar where she was attending a bachelorette party landed Jaime Rutkowski in jail, threatened her life and lead to a lawsuit that on Monday yielded $125,000 from the city.

On Oct. 16, Ms. Rutkowski, who has diabetes, said she was thrown to the ground and arrested on charges of possession of marijuana outside a club on Ludlow Street on the Lower East Side.

Stress elevates her blood sugar levels and at the nearby police station house, the blood sugar meter she uses was confiscated. She relied on the meter to determine how much insulin to inject into her system from an insulin pump inserted in her stomach. An overdose could be life-threatening.

The police eventually called for an ambulance more than three hours after Ms. Rutkowski had been taken into custody. Emergency medical technicians found that her sugar level was almost four times the normal level, dangerous enough to take her to Bellevue Hospital Center.

Ms. Rutkowski and her lawyer, Joel Berger, filed a suit against the city and the officers involved in part because they hope it will alert the the Police Department to the needs of diabetic prisoners.

“The settlement is so high because a woman nearly died,” said Mr. Berger.

Mr. Berger also said Ms. Rutkowski’s crime was “trivial.” He added: “Almost any jury was not going to be exactly shocked by the nature of the offense. They’re not going to view this as the crime of the century.”

Ms. Rutkowski was charged with a class-B misdemeanor and received an adjournment in contemplation of dismissal, which means that she was not fined and that after one year her case will be dropped and sealed.

Elizabeth Thomas, a spokeswoman for the city’s Law Department, said, “We believe the settlement is in the best interest of all the parties.”

The Police Department’s aggressive enforcement of marijuana possession laws has led to an increase in arrests for possessing small amounts of the drug. While many of those arrests result in fines but no jail time, they do typically result in spending a night in jail.

“They could have killed me over a joint,” Ms. Rutkowski said. “Something needs to be done.”

Mr. Berger said the police did not have a specific protocol to deal with diabetic patients, something that he believes needs to be addressed. “Police officers need to understand that when they arrest a diabetic, there are potentially life-threatening effects,” he said.

Ms. Rutkowski said she would use money from the settlement to pay student loans and to further her education. A graduate of Temple, where she studied chemistry, she said she’s interested in pursuing a degree as a doctor of veterinary medicine. “I’m going to try and make something good out of a terrible situation,” she said.

The writer and social critic, Malcolm Gladwell, defines the ‘Tipping Point’ as the moment of critical mass, the threshold, the boiling point; the point at which the buildup of minor changes or incidents reaches a level that triggers a more significant change or makes someone do something they had formerly resisted.
Another way of saying it would be that point in time and space when everything changes and there’s no turning back.
Every day there are more encouraging headlines appearing in newspapers and on the Web from California to Maine supporting medical marijuana legislation suggesting the tide is turning.
Even when the cynics call medical marijuana a joke and claim the real goal of this smokescreen movement is legalization of pot, there are medi-jane supporters with valid and logical arguments to counter-balance any archaic rhetoric with which the anti-pot forces continue to misinform.

New Jersey passed one of the most restrictive medical marijuana rights and benefits program on the books so far. The state with a very conservative governor will soon have medical marijuana. Why? Because the people wanted it.
 It does seem like Time is marching on, but when is it gonna get there?
We’re zeroing in on something but when is the Tipping Point going to kick in fully regarding medical marijuana?
What possible signs do we need to see before we believe that it works?!
Here are some small recent events that may prove someday to have influenced the way we think, tipping the scales our way towards a bigger picture…

During the question-and-answer part of the competition, Miss California Alyssa Campanella was asked about her perspective on the medicinal cannabis.
“Well, I understand why that question would be asked, especially with today’s economy, but I also understand that medical marijuana is very important to help those who need it medically,” Alyssa said.
“I’m not sure if it should be legalized, if it would really affect, with the drug war,” she said. “I mean, it’s abused today, unfortunately, so that’s the only reason why I would kind of be a little bit against it, but medically it’s OK.”
She got Miss USA.
When’s the last time you had the crown on the line and you spoke the truth?
I actually can understand why someone could dismiss a beauty queen and a cancer patient as being not scientific enough. They’re just regular people.

In an unlikely move for the head of a major company, Scott’s Chief Executive Jim Hagedorn said he is exploring targeting medical marijuana as well as other niches to help boost sales at his lawn and garden company.
“I want to target the pot market,” Mr. Hagedorn said in an interview.
“There’s no good reason we haven’t.”

Congressmen Ron Paul, Barney Frank and others will introduce legislature Thursday that aims to end a major part of the war on drugs — namely the battle against marijuana.
Reps. Paul (R-Texas) and Frank (D-Mass.), though technically on opposite sides of the aisle, have often spoken out against the war on drugs and will propose a bill “tomorrow ending the federal war on marijuana and letting states legalize, regulate, tax, and control marijuana without federal interference,” according to a statement from the Marijuana Policy Project via Reason.
The bill would allow the individual states to decide how they want to deal with pot.
The legislation, co-sponsored by Rep. John Conyers (D-Mich.), Rep. Steve Cohen (D-Tenn.), Rep. Jared Polis (D-Colo.), and Rep. Barbara Lee (D-Oakland), is the first of its kind to be proposed in Congress that would end the 73-year-old federal marijuana prohibition that began with the Marijuana Tax Act of 1937.

These four events that just transpired in the last month couldn’t be more current, more ‘now.’ What is it going to take in order for that cosmic plate to tilt to our side? And stay that way!
Entrepreneurs and forward thinkers are testing the waters of the medical marijuana Industry with venture capitalists abroad throwing dollars into edible research think-tanks and other esoteric ganja-related enterprises.
Politicians and law enforcement from all walks and talks of life are coming forward, decrying that the time is now to lose the campaigns that have never worked and to embrace a new way of thinking. To challenge the uncommon wisdom and to end the wars on law abiding citizens who because they ingest a specific weed, they could have their lives ruin because we, as a nation and a society refuse to change.
Sixteen states support medical marijuana. Every poll taken shows public support for medical marijuana. GW Pharma (Weed) and Novartis (Ritalin, Excedrin) have become partners in Sativex (medical marijuana spray) licensing pact overseas and now, in America.
“My professional view of cannabis as a substance is that it appears to be a remarkably safe substance in comparison to most medicines prescribed today,” said Dr. Geoffrey Guy, chairman of GW Pharmaceuticals. “The more I learn about this plant the more fascinated I become. It has through its various constituents multiple effects of therapeutic interest, many of which are now being validated by the enormous growth in basic cannabinoid research.”
What is it about marijuana that makes us afraid to go forward and embrace a new safer tomorrow? Pharmaceutical giants are moving forward with patents and marketing. You would think that the data from research geeks would be refutable, they’re the same people who give us our aspirin, for gosh sakes.
The data’s coming in like a Haboob through Phoenix. Unstoppable. Marijuana has applications that can help certain people. That’s it. It can’t be changed.
Marijuana does some good. It’s proven.
You can’t go backwards with that. Only thing you can do is not open your eyes to what’s in front of them.
Why aren’t we coming together as a nation over this issue when people with perspectives as different as those of Miss USA to the Mormon Attorney General of Utah support medical marijuana?
When law enforcement officials and Ex-President Jimmy Carter come forward to say the War on Drugs not only doesn’t work, it’s unwinnable. A waste of money.
Speaking of money, when Wall Street, Main Street and Home Depot all say the time is right to build the future fields of dreams of medical marijuana that only Weed-Gro can protect. What more do we need to hear?
Do we need Nancy Reagan in her Chanel housecoat to come forward to say she was wrong? Would that be the final straw? Would that be our national Tipping Point? To have someone other than ourselves say it is okay for us to have this weed? Mommy, please say its okay because in 1937, someone said it was bad.
Right now President Obama has alienated the Ganja Nation with his reversal on leaving the medical marijuana community alone. More and more his obtrusive agenda is forcing the hand of medical marijuana to take a stand, one way or another in various localities. Howard Zinn said you can’t be neutral on a moving train.
Opinion is sliding to the side where the weed grows green and high. Mendocino County is aggressively constructing a platform that is workable for growers and law enforcement alike. Not perfect, but a start.
Growers are paying taxes in exchange for their right to grow medical marijuana. They pay just like anyone else.
The Tipping Point is already here. Embrace it.

Administration Medical Marijuana Memo Causes Dismay, Anger

The medical marijuana movement is reeling after the Obama Justice Department released a memo last week declaring that it might prosecute large-scale medical marijuana cultivation operations and dispensaries even in states where they are operating in compliance with state laws. Advocates reacted with dismay and disappointment, even as they plotted strategies about what to do next.

The memo, written by US Deputy Attorney General James Cole, “clarifies” the October 2009 memo from then-Deputy Attorney General David Ogden that told federal prosecutors not to focus their resources on patients and providers in compliance with state laws. The earlier memo gave some substance to President Obama’s campaign promise not to persecute medical marijuana patients and providers in states where it is legal.

But after the 2009 memo, federal officials watched aghast as a veritable medical marijuana cultivation and dispensary boom took off in places such as Colorado and Montana, where dispensaries went from near zero to hundreds of operations, and as localities in California began considering huge commercial grows. The Justice Department responded with increased federal raids — now at twice the rate of the Bush administration, according to Americans for Safe Access, the nation’s largest medical marijuana advocacy organization — and earlier this year, sent threatening letters from US Attorneys to governors and legislators in states considering or implementing medical marijuana distribution programs.

Those letters “are entirely consistent with the October 2009 memorandum,” Cole argued in last week’s memo. “The Department of Justice is committed to the enforcement of the Controlled Substances Act in all states. Congress has determined that marijuana is a dangerous drug and that the illegal distribution and sale of marijuana is a serious crime that provides a significant source of revenue to large scale criminal enterprises, gangs, and cartels,” Cole continued.

Noting that “some of these jurisdictions have considered approving the cultivation of large quantities of marijuana, or broadening the regulation and taxation of the substance,” Cole reiterated the Ogden memo’s message that “it is likely not an efficient use of federal resources to focus enforcement efforts on individuals with cancer or other serious illnesses who use marijuana as part of a recommended treatment regimen consistent with applicable state law, or their caregivers.”

He then took care to narrowly define the term “caregiver,” which is commonly applied to people growing medical marijuana for authorized patients. “The term ‘caregiver’ as used in the memorandum meant just that: individuals providing care to individuals with cancer or other serious illnesses, not commercial operations cultivating, selling or distributing marijuana.”

Cole then went on to write that it is not the Obama administration’s position that has changed, but facts on the ground. “There has, however, been an increase in the scope of commercial cultivation, sale, distribution and use of marijuana for purported medical purposes. For example, within the past 12 months, several jurisdictions have considered or enacted legislation to authorize multiple large-scale, privately-operated industrial marijuana cultivation centers. Some of these planned facilities have revenue projections of millions of dollars based on the planned cultivation of tens of thousands of cannabis plants,” he wrote.

The 2009 memo “was never intended to shield such activities from federal enforcement action and prosecution, even where those activities purport to comply with state law,” Cole continued. “Persons who are in the business of cultivating, selling or distributing marijuana, and those who knowingly facilitate such activities, are in violation of the Controlled Substances Act, regardless of state law… Those who engage in transactions involving the proceeds of such activity may also be in violation of federal money laundering statutes and other federal financial laws.”

It didn’t take long for the medical marijuana and drug reform movements to fire back. While some took small solace in the fact that patients are still protected from federal persecution, the dominant reaction was dismay and disgust.

“It is disingenuous of the Obama Administration to say it is not attacking patients while obstructing the implementation of local and state medical marijuana laws,” said ASA executive director Steph Sherer. “The president is using intimidation tactics to stop elected officials from serving their constituents, thereby pushing patients into the illicit market.”

“Well, this is disappointing,” said Dale Gieringer, long-time head of California NORML. “It certainly conflicts with Obama’s original implication that he would let the states take care of medical marijuana. Now, it’s the same as Bush’s policy. Even before this memo came out, people have been saying for a long time that with a raid here and a raid there, it seemed like no real change in federal policy, and now — bingo — it’s confirmed.”

The Cole memo “raises more questions than it answers,” said Bill Piper, national affairs director for the Drug Policy Alliance. “The department’s 2009 Ogden memorandum established guidance that federal resources should not be employed to target medical marijuana patients and providers who are in ‘clear and unambiguous compliance’ with state-based medical marijuana laws. Last week’s so-called clarification is in fact open to many interpretations and falls far short of the explanation of policy that state lawmakers, members of Congress and advocates sought.”

While the Cole memo clearly states that large-scale commercial grows are now targeted, even if they are in compliance with state laws, Piper noted, it “does not provide guidance on what the federal government considers to be the line between small and large-scale production.”

Piper pointed out that regardless of federal policy, states can still legalize marijuana for medicinal use. He also called out politicians who hide behind fears of the feds to stall or thwart medical marijuana programs and scoffed at the notion that state employees could be prosecuted for setting up registries or collecting medical marijuana taxes.

“State officials who await blanket federal endorsement of medical marijuana or blame the federal government for their own failure to act are compromising the health and well being of their citizens while failing to implement in good faith the laws of their state,” he said. ”With regard to concerns about prosecution of state employees, which some state policymakers have expressed, the federal government has never sought to prosecute any state employee for licensing or otherwise regulating medical marijuana providers. In fact, we know of no instance in recent times in which state officials were personally prosecuted for implementing any state law. It is something that is just not done.”

For Gieringer and other medical marijuana advocates, the Obama administration’s behavior on the issue has dried up any reservoirs of good will generated by his campaign promise and the Ogden memo. Now, the administration is in the movement’s cross hairs.

“They want to put a stop to any large scale distribution of medical marijuana, but all they’re doing is prolonging the conflict between federal law and reality,” Gieringer said. “We have to put pressure on Obama. He’s up for reelection; he owes us an explanation of his waffling on this issue, and certainly his failure to address rescheduling. The reform movement needs to press him on this and inject it into the campaign. Why has he ignored all the studies, why has he ignored the rescheduling petition, why does he persist in sending people to prison for medical marijuana crimes? If we can put him on the defensive during the campaign, we might get a concession.”

“The Obama Administration missed a huge opportunity to ease the state/federal conflict over medical marijuana and pave the way for responsible regulation in 16 states and the District of Columbia, home to 90 million Americans,” agreed Piper. “By issuing vague guidance, the Obama Administration is sowing confusion and doing voters, state policymakers, and medical marijuana patients a disservice. The administration needs to be clear in its support of responsible state and local regulations designed to make marijuana legally available to patients while enhancing public safety and health. If the federal government is unable to provide leadership in this area, then the very least it can do is get out of the way and allow citizens to determine the policies that best serve local interests.”

But the administration has given no indication it is likely to do that. Relations between the medical marijuana movement and the Obama administration are starting to feel like the Cold War.

New Hope For PA Medical Marijuana Bill

The medical cannabis bill in Pennsylvania has been stalled in House and Senate committees but some procedural wrangling this week could put the issue back in motion. HB 1653 was first assigned to the House Health Committee chaired by Rep. Matthew Baker. At previous public hearings Baker was a vocal opponent of the measure. Today the bill was re-referred to the House Human Services Committee. This means much better chances that public hearings and/or a committee vote will be be scheduled.

This year the PA bill was also re-named The Governor Raymond P. Shafer Compassionate Use Medical Marijuana Act. This is to honor the former Republican governor who guided a commission for President Nixon on the topic of marijuana. In 1972 Shafer delivered a report that cannabis should not be classified with other narcotics and that personal possession should be decriminalized. There were also clear considerations about the medical use of cannabis in the report.

Previously the PA House Health and Human Services Commitee was combined and had 26 members. This year the committee was split into two separate entities.

At public hearings held in 2009 and 2010 testimony strongly favored the medical marijuana bill. Seriously ill residents, religious leaders, advocates, doctors and nurses spoke about the benefits of cannabis but the the bill never got a vote.

Patrick Nightingale, a Pittsburgh based attorney who serves on the Board of Directors at Pennsylvanians for Medical Marijuana (PA4MMJ), said today, ”Critically ill patients throughout the Commonwealth of Pennsylvania are begging merely that their voice be heard by their elected representatives.”

“The answer is not to ignore or bury the legislation but rather to give it a full and fair hearing,” Nightingale added.

Dr. Harry Swidler, an Emergency Medicine physician said at the 2009 hearings: “Marijuana is non-addicting. There is no physical dependence or physical withdrawal associated with its use. It is, from a practical standpoint, non-toxic. Marijuana is safer by some measures than any other drug. There is simply no known quantity of marijuana capable of killing a person.”


Pennsylvania’s medical marijuana bill is active in both chambers of the General Assembly. In April state senator Daylin Leach re-introduced SB 1003, but it remains stalled in the Senate Health and Public Welfare Committee chaired by Senator Patricia Vance. Advocates are hopeful that renewed action in the House will help the effort to have Senate hearings as well.

Derek Rosenzweig of Philadelphia spearheaded the PA4MMJ effort and testified at previous public hearings. He said in an email today: “With the introduction of legislation in the US Congress today that would remove marijuana from the federal Schedule I classification, states such as Pennsylvania may soon be free of federal interference in implementing medical marijuana laws. Activists across the state have been pushing for a vote. Everyone at PA4MMJ has been making phone calls and sending emails.”

Legislation To End U.S. Marijuana Prohibition Coming Thursday

​The first bill ever introduced in Congress to end federal marijuana prohibition is coming on Thursday, June 23. Historic, bipartisan legislation which would end the United States’ war on marijuana — and allow states to legalize, tax regulate and control cannabis commerce without federal interference — will be introduced by Rep. Barney Frank (D-Mass.) and Rep. Ron Paul (R-Texas).

Co-sponsors of the bill include Rep. John Conyers (D-Mich.), Rep. Steve Cohen (D-Tenn.), Rep. Jared Polis (D-Colo.), and Rep. Barbara Lee (D-Calif.)

The legislation would limit the federal government’s role in marijuana enforcement to cross-border or interstate smuggling, allowing people to legally grow, use or sell marijuana in states where it is legal.

Leading critics of the war on marijuana will explain the legislation’s significance for state and national marijuana policy at a national press teleconference on Thursday.
A group of police and judges who fought on the front lines of the failed War On Drugs is announcing its support for the legislation, which is called the Ending Federal Marijuana Prohibition Act of 2011.
“Clearly the ‘war on drugs’ has failed, and nowhere is that more clear than with respect to marijuana,” said Neill Franklin, a former Baltimore narcotics cop and executive director of Law Enforcement Against Prohibition (LEAP). “It baffles me that we arrest nearly 800,000 people on marijuana charges in this country each and every year at taxpayer expense when we could instead be taking in new tax revenue from legal and regulated marijuana sales.

Last week marked the 40th anniversary of President Richard Nixon’s declaring war on marijuana and other drugs. In an op-ed in the New York Times last week, timed for the 40th anniversary, former President Jimmy Carter called for reforming marijuana laws.
The legislation also comes on the heels of the Global Commission on Drug Policy, which released a report on June 2 calling for a major paradigm shift in how our society deals with drugs, including calling for legal regulation of marijuana. The report sent a jolt around the world, generating thousands of international media stories.
The Commission is comprised of international dignitaries including Kofi Annan, former Secretary General of the United Nations; Richard Branson, entrepreneur, founder of the Virgin Group; and the former presidents of Brazil, Colombia, Mexico, and Switzerland. Representing the United States on the Commission are George P. Shultz, Paul Volcker and John Whitehead.
More than 46 percent of Californians voted last year to legalize marijuana in their state, and voters in Colorado, Washington and possibly other states are expected to vote on the issue next year. In the past year, five state legislatures have considered legalizing marijuana, including California, Maine, Massachusetts, Rhode Island, and Washington state.
Sixteen states and the District of Columbia have legalized marijuana for medical use, but the federal Drug Enforcement Administration (DEA) continues to arrest people under federal law, and U.S. Attorneys have in recent months sent threatening letters to state policymakers in an apparent attempt to meddle in state decision-making.
Rep. Frank’s legislation would end state/federal conflicts over marijuana policy, reprioritize federal resources, and provide more room for states to do what is best for their own citizens, according to the Washington, D.C.-based Marijuana Policy Project (MPP).

Marijuana Advocate Gary Johnson Snubbed In CNN Presidential Debate Last Night

CNN is holding its first televised debate among Republican presidential candidates tonight, but while the cable news network has issued invitations to several non- or yet-to-announce candidates, it is excluding one announced candidate who meets the criteria for inclusion. Former New Mexico Gov. Gary Johnson, an avowed and articulate opponent of drug prohibition, was not invited to participate, and his campaign and supporters are crying foul.

CNN, along with WMUR-TV and the Manchester Union-Leader, the debate cosponsors, set the bar for an invitation at the candidate having received an average of at least 2% in at least three national polls during the month of May. According to the Johnson campaign, Johnson has met that hurdle, polling an average of precisely 2% in three national polls last month.

“It is our hope that CNN will review the criteria that has excluded two-term Governor Gary Johnson from the New Hampshire debate,” said senior Johnson campaign advisor Ron Nielson on Saturday. “Now that this information has come to light, we look forward to receiving an invitation for Governor Johnson to participate.”

But just hours before the debate airs, there is no sign CNN has changed its mind. Instead, the network will present front-runner former Massachusetts Gov. Mitt Romney, former Minnesota Gov. Tim Pawlenty, former House Speaker Newt Gingrich, Texas Congressman Ron Paul, Godfather’s Pizza entrepreneur Herman Cain, non-announced candidate Minnesota Congresswoman Michele Bachmann, and former Pennsylvania Sen. Rick Santorum.

Most of the invitations are well-justified. According to Real Clear Politics’ aggregate poll data (which also does not include Johnson) all of the invitees are above 2%, although Santorum, at 3.2% overall, only averaged 2.67% in three May polls. Non-announced candidate Bachmann is averaging 5.1%, although that’s a decline from her May poll average of 7%.

Still, why Johnson was excluded even though he has officially announced and meets the debate criteria remains a mystery. CNN said it only wanted “serious” candidates with at least 2% of the vote, but also admitted it failed to include Johnson in its own polls.

Well, Republican-leaning drug reformers will at least have Ron Paul to listen to tonight.

10) MARIJUANA USE HAS NO EFFECT ON MORTALITY:
A massive study of California HMO members funded by the National Institute on Drug Abuse (NIDA) found marijuana use caused no significant increase in mortality. 9) HEAVY MARIJUANA USE AS A YOUNG ADULT WON’T RUIN YOUR LIFE:
Veterans Affairs scientists looked at whether heavy marijuana use as a young adult caused long-term problems later, studying identical twins in which one twin had been a heavy marijuana user for a year or longer but had stopped at least one month before the study, while the second twin had used marijuana no more than five times ever. Marijuana use had no significant impact on physical or mental health care utilization, health-related quality of life, or current socio-demographic characteristics. Eisen SE et al. 8) THE “GATEWAY EFFECT” MAY BE A MIRAGE:
Marijuana is often called a “gateway drug” by supporters of prohibition, who point to statistical “associations” indicating that persons who use marijuana are more likely to eventually try hard drugs than those who never use marijuana – implying that marijuana use somehow causes hard drug use. But a model developed by RAND Corp. researcher Andrew Morral demonstrates that these associations can be explained “without requiring a gateway effect.” More likely, this federally funded study suggests, some people simply have an underlying propensity to try drugs, and start with what’s most readily available. 7) PROHIBITION DOESN’T WORK (PART I):
The White House had the National Research Council examine the data being gathered about drug use and the effects of U.S. drug policies. NRC concluded, “the nation possesses little information about the effectiveness of current drug policy, especially of drug law enforcement.” And what data exist show “little apparent relationship between severity of sanctions prescribed for drug use and prevalence or frequency of use.” In other words, there is no proof that prohibition – the cornerstone of U.S. drug policy for a century – reduces drug use. 6) PROHIBITION DOESN’T WORK (PART II):
(DOES PROHIBITION CAUSE THE “GATEWAY EFFECT”?): U.S. and Dutch researchers, supported in part by NIDA, compared marijuana users in San Francisco, where non-medical use remains illegal, to Amsterdam, where adults may possess and purchase small amounts of marijuana from regulated businesses. Looking at such parameters as frequency and quantity of use and age at onset of use, they found no differences except one: Lifetime use of hard drugs was significantly lower in Amsterdam, with its “tolerant” marijuana policies. 5) OOPS, MARIJUANA MAY PREVENT CANCER (PART I):
Federal researchers implanted several types of cancer, including leukemia and lung cancers, in mice, then treated them with cannabinoids (unique, active components found in marijuana). 4) OOPS, MARIJUANA MAY PREVENT CANCER, (PART II):
In a 1994 study the government tried to suppress, federal researchers gave mice and rats massive doses of THC, looking for cancers or other signs of toxicity. The rodents given THC lived longer and had fewer cancers, “in a dose-dependent manner” (i.e. the more THC they got, the fewer tumors). 3) OOPS, MARIJUANA MAY PREVENT CANCER (PART III):
Researchers at the Kaiser-Permanente HMO, funded by NIDA, followed 65,000 patients for nearly a decade, comparing cancer rates among non-smokers, tobacco smokers, and marijuana smokers. Tobacco smokers had massively higher rates of lung cancer and other cancers. Marijuana smokers who didn’t also use tobacco had no increase in risk of tobacco-related cancers or of cancer risk overall. In fact their rates of lung and most other cancers were slightly lower than non-smokers, though the difference did not reach statistical significance. Sidney, S. et al. 2) OOPS, MARIJUANA MAY PREVENT CANCER (PART IV):
Donald Tashkin, a UCLA researcher whose work is funded by NIDA, did a case-control study comparing 1,200 patients with lung, head and neck cancers to a matched group with no cancer. Even the heaviest marijuana smokers had no increased risk of cancer, and had somewhat lower cancer risk than non-smokers (tobacco smokers had a 20-fold increased lung cancer risk). Tashkin D. 1) MARIJUANA DOES HAVE MEDICAL VALUE:
In response to passage of California’s medical marijuana law, the White House had the Institute of Medicine (IOM) review the data on marijuana’s medical benefits and risks. The IOM concluded, “Nausea, appetite loss, pain and anxiety are all afflictions of wasting, and all can be mitigated by marijuana.” While noting potential risks of smoking, the report added, “we acknowledge that there is no clear alternative for people suffering from chronic conditions that might be relieved by smoking marijuana, such as pain or AIDS wasting.” The government’s refusal to acknowledge this finding caused co-author John A.
